[Informational Gaming Hearing] 

Criminal Background Investigations and Sharing of Information

The Community, Economic and Recreational Development Committee will be hearing testimony concerning the sharing of information in relation to the criminal background investigation process required by the Gaming Act.

Various questions have been raised recently about the criminal background investigation process overseen by the Pennsylvania Gaming Control Board (PGCB), Bureau of Investigations and Enforcement (BIE), in terms of their ability to receive certain criminal information from various law enforcement agencies pursuant to federal law (specifically with regards to the ability of the Pennsylvania State Police to share criminal information with the PGCB, BIE, which the Gaming Act itself has specified as a criminal justice agency under 18 Pa.C.S. Ch. 91 [relating to criminal history record information]).  Given these questions, a public hearing on such matters will help ensure the public is properly educated on past and current practices with regard to criminal background investigations.  It is important that the Commonwealth ensures and maintains a high level of integrity and public confidence in the PA Gaming Industry and the regulation of that industry.
